Terms of Service

These Terms of Service (“Terms”) govern website design, development, and website care services provided by Mainstay Studio, a sole proprietorship operated by Duy Nguyen and based in the greater Austin, Texas area (“Mainstay Studio,” “we,” or “us”) to you, the client (“you”).
By approving a written proposal, paying a deposit, or subscribing to a care plan, you agree to these Terms.
1. Services
We provide two categories of service:
- Website launch — a one-time project to design, build, and publish a website for your business. Scope, deliverables, and price are confirmed in a written proposal before any payment is requested. Launch projects start at $2,000 USD.
- Website Care — an optional recurring monthly subscription covering managed hosting, SSL, uptime monitoring, backups, and a defined number of small content updates. Care plans start at $99 USD per month.
Additional services such as local SEO setup, extra pages, or booking integrations are quoted separately in writing.
2. Pricing and currency
All prices are stated and charged in United States dollars (USD). Prices published on this website are starting prices; your final price is the one stated in your written proposal.
3. Payment terms
- Website launch projects are billed 50% before work begins and 50% at go-live.
- Care plan subscriptions are billed monthly in advance, beginning at launch or on the date you subscribe.
- Payments are processed by Stripe. We do not store or handle your card details.
- Invoices are due on receipt. Work may be paused on balances more than 14 days past due.
4. Delivery timeline
Most websites go live within 7–14 days of project start, provided you supply the required content — business details, service list, photos, and any licensing or warranty information — in a timely manner. Timelines are estimates and may shift if content or feedback is delayed.
5. Revisions
Launch projects include up to two rounds of revisions before go-live. Revisions are changes to text, images, colors, and layout within the agreed scope. Requests that add new pages, new features, or a different overall direction are new work and will be quoted separately.
6. Your responsibilities
- Provide accurate business information, and confirm that any licenses, certifications, warranties, or guarantees described on the site are true and current.
- Provide content you have the right to use. You represent that any photos, logos, or text you supply do not infringe anyone else’s rights.
- Respond to review requests within a reasonable time so the project can move forward.
7. Ownership
Once your project is paid in full, you own the content and the finished website design we produced for you. You retain ownership of your domain name, your logo, and any content you supplied to us throughout.
We retain ownership of our underlying tools, templates, code components, and processes, which we may reuse on other projects. We may display your finished site in our portfolio unless you ask us in writing not to.
If you end a care plan, we will provide an export of your site files on request, once any outstanding balance is paid.
8. Third-party services
Your site may rely on third-party providers for hosting, domain registration, email, analytics, or payment processing. Those services are governed by their own terms, and we are not responsible for their outages, pricing changes, or policy changes.
9. Cancellation and refunds
Cancellation and refund terms are described in our Refund & Cancellation Policy, which forms part of these Terms.
10. Warranty disclaimer
We build carefully and stand behind our work, but we do not guarantee specific business results — including search rankings, traffic volume, call volume, or revenue. Except as expressly stated here, services are provided “as is” without warranties of any kind.
11. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to these Terms is limited to the amount you paid us for the service giving rise to the claim during the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Texas. Before filing anything, both parties agree to try to resolve the issue directly — email us and we will respond.
13. Changes to these Terms
We may update these Terms from time to time. The “last updated” date above reflects the current version. Material changes affecting an active subscription will be communicated by email at least 30 days in advance.
